Questions
What New York parents ask us.
Do New York parents have to use a licensed agency?
A program that matches a surrogate who lives or delivers in New York must be licensed by the NYS Department of Health. You can confirm any agency's license on the Department's public list.
Can New York parents work with a surrogate in another state?
Yes. Many do. The law of the state where your surrogate lives and delivers will usually govern your agreement and parentage order, and your attorney will advise on which applies.
Does New York insurance cover surrogacy?
New York requires large-group plans to cover IVF for the insured person, but not the costs of a surrogate's pregnancy. Check your plan document, and ask whether your employer offers a separate family-building benefit.
